TERMS OF USE

1. PURPOSE

Keolis has taken the initiative of deploying the platform https://careers.keolis.com  (“the Platform”), an erecruitment platform whose main aim is to provide Users with access to the job offers in the Keolis Group and apply online. The purpose of these Terms of Use (“TOU”) is to set out the conditions in which Users are allowed to browse the Platform. 

The TOU automatically apply to every visit, use, registration and connection to the Platform. The User is deemed to have read and unreservedly accepted the TOU.

The applicable TOU are those in force at the date on which the User visits the Platform. It is furthermore specified that Keolis SA is free to add to, modify, correct or erase all or part of the TOU at any time. Through their online publication, these modifications are regarded as having been brought to the attention of Users. Consequently, they are presumed to be accepted by any User visiting the Platform subsequently to their publication. Users are therefore invited to consult them at each visit and connection so as to consult the latest version available on the Website.   

2. ACCESS TO THE PLATFORM

Access to the platform is open to anyone.

Keolis SA reserves the right to modify, suspend, restrict or interrupt access to all or part of the Platform, including access to its content and functions or the hours at which the Platform can be consulted, without notice.

Keolis SA reminds Users that their Password is personal and confidential. As such, each connection and action are deemed to have been performed by the holder of the login and password entered. 

2.1 CREATION OF A USER ACCOUNT 

To browse the Platform and apply for the Keolis Group’s job offers, each User must create their user account.  To do so, the User must provide the following details: last name, first name, e-mail address and personal password. The User must enter a personal password comprising a minimum of two (2) characters and a maximum of eighteen (18) characters, and which cannot include any spaces or Unicode characters. 

2.2 FORGOTTEN AND LOST PASSWORDS

If the User forgets or loses their password, they may reset it using the function “Forgot your password?” To issue a new password, the Platform will ask for the User’s e-mail address which was entered when they created their account.

2.3 DELETION OF ACCOUNT

If the User wishes to delete their account, they may do so by clicking on “Delete Profile’ in the “My Candidate Profile” section.

3. INTELLECTUAL PROPERTY

The Platform and all its constituent parts (including texts, documents for download, trademarks and logos, etc.) and related software are protected by intellectual property rights and related rights, reserved solely to the holders of these rights. 

Unless otherwise authorised by Keolis SA, and with the exception, in particular, of reproductions without modifications or alterations made for the purposes of personal and private copies in accordance with Article L. 122-5, 2° of the Intellectual Property French Code, any use, exploitation, reproduction, representation, dissemination, edition or publication, in whole or in part, of the Website and/or its constituent parts, in any form/format whatsoever, on any support whatsoever and for any purpose whatsoever (commercial, advertising...) is strictly prohibited and shall constitute a prosecutable offence.

5. COOKIES AND HYPERLINKS 

5.1 COOKIES

Cookies are text files deposited on your terminal (computer and/or mobile device) by your web browser when you visit a website. 

On our Platform, no cookies are deposited on your terminal. 

5.2 HYPERLINKS 

Anyone wishing to set up a hyperlink to the Platform must obtain the explicit and advance approval of Keolis SA. Requests to establish a hyperlink to the Platform must be submitted to the following email address: supporttalent@keolis.com

6. LIABILITY

Despite all the care taken in creating and updating the Platform, errors, inaccuracies or omissions may still occur. In addition, Keolis SA shall make every effort to guarantee the accessibility of the Platform, however, connection problems or interruptions when connecting to the Platform may occur. Indeed, this access may be suspended, notably for maintenance reasons and/or Internet network quality. Keolis SA does not offer any guarantees against the risk of interruption or malfunction attributable to the connection, the congestion of the computer network and/or systems, unauthorised third-party intrusions and contamination by any viruses circulating on the said computer networks and/or systems. 

In the event that the liability of Keolis SA is sought owing to a breach of its obligations under these TOU, the injured Party may claim full compensation for damages, on the understanding that Keolis SA shall not held liable for indirect damages: the Parties shall refer to the provisions of Article 1231-4 of the French Civil Code as regards their qualification. In all events, the liability of Keolis SA shall not be limited and/or waived in the event of personal injury, gross negligence or fraudulent misconduct.

8. APPLICABLE LAW

These TOU are subject to French law. 

These TOU are established in French, notwithstanding any translations which may subsequently be made thereof. In all events, the French version of these TOU shall prevail over any other version in a foreign language.

In the event of any dispute relating to the validity, interpretation or execution of these TOU, Keolis SA and the User agree to consult with one another to seek an amicable solution to their dispute within a period of sixty (60) calendar days.

In the event of failure to reach an amicable solution, any dispute relating to the interpretation, validity, and/or execution of these TOU shall be submitted to the courts of Paris holding due jurisdiction, including in the case of multiple defendants or introduction of a third party, for proceedings aiming to obtain emergency or provisional measures, in summary proceedings or on application.
